ARTICLE 2 - Prices
The Products are provided at the current prices listed on the website https://modware.store, when the Seller places the order.
Prices are expressed in Euros, excluding and including VAT. The prices take into account any discounts granted by the Seller on the website https://modware.store.
These prices are fixed and cannot be revised during their validity period, but the Seller reserves the right to modify the prices at any time outside of their validity period.
Prices do not include processing, shipping, transport, and delivery costs, which are charged in addition, under the conditions indicated on the website and calculated prior to placing the order.
The payment requested from the Customer corresponds to the total amount of the purchase, including these costs. An invoice is issued by the Seller and provided to the Customer upon delivery of the ordered Products.

ARTICLE 3 – Orders
It is the Customer's responsibility to select the Products they wish to order on the website https://modware.store, according to the desired terms and conditions.
Product offers are valid as long as they are visible on the website, while stocks last.
The sale will only be considered valid after full payment.
It is the Customer's responsibility to verify the accuracy of the order and to immediately report any errors.
Any order placed on the website https://modware.store constitutes the formation of a distance contract between the Customer and the Seller. 6
The Seller reserves the right to cancel or refuse any order from a Customer with whom there is a dispute regarding the payment of a previous order.
The Customer may track the progress of their order on the website.

ARTICLE 3 Bis - Customer Area - Account
In order to place an order, the Customer is invited to create an account (personal space). To do so, they must register by completing the form provided when placing their order and agree to provide truthful and accurate information regarding their marital status and contact details, including their email address. The Customer is responsible for updating the information provided. They are informed that they can modify it by logging into their account. To access their personal space and order history, the Customer must log in using their username and password, which will be communicated to them after registration and which are strictly personal. As such, the Customer is prohibited from disclosing them. Otherwise, they will remain solely responsible for their use. The Customer may also request to unsubscribe by visiting the dedicated page in their personal space or by sending an email to: warningmalwareorder@gmail.com. This will be effective within a reasonable time. In the event of non-compliance with the general conditions of sale and/or use, the site https://modware.store will have the possibility of suspending or even closing a customer's account after formal notice sent electronically and remaining without effect. Any deletion of an account, whatever the reason, results in the pure and simple deletion of all the Customer's personal information. Any event due to a case of force majeure resulting in a malfunction of the site or server and subject to any interruption or modification in the event of maintenance, does not engage the liability of the Seller. The creation of the account entails acceptance of these general conditions of sale.

ARTICLE 4 - Payment Terms
The price is paid via secure payment, using the following methods: payment by credit card or bank transfer to the Seller's bank account (the details of which are provided to the Customer when placing the order). The price is payable in full by the Customer on the day the order is placed. Payment details are exchanged in encrypted mode using the protocol defined by the authorized payment service provider responsible for banking transactions carried out on the website https://modware.store. Payments made by the Customer will only be considered final after the Seller has actually received the amounts due. The Seller will not be required to deliver the Products ordered by the Customer if the Customer does not pay the price in full under the conditions indicated above.

ARTICLE 5 - Deliveries
The Products ordered by the Customer are digital goods and will be delivered after full payment of the order. Delivery is made as follows:
Game saves and software: sent by email to the address provided by the Customer when ordering.
In-game services: delivered within a maximum of 48 hours, depending on the availability of the Seller and the Customer.
Deliveries are made to the email address provided by the Customer when ordering on the website. Delivery consists of the transfer of access to or control of the digital Product to the Customer. Except in special cases or when a service is unavailable, all Products ordered will be delivered at once.
The Seller undertakes to make every effort to deliver the Products ordered by the Customer within the timeframes mentioned above. If delivery has not taken place within 24 hours of the expiration of the stated delivery time, for any reason other than force majeure or fault on the part of the Customer, the sale may be terminated at the Customer's written request, in accordance with Articles L 216-2, L 216-3, and L 241-4 of the French Consumer Code. In this case, the amounts paid by the Customer will be refunded no later than fourteen days following the request to cancel the contract, excluding any compensation or withholding.
The Customer is required to verify the conformity of the delivered Products. They have 24 hours from receipt to submit complaints by email, accompanied by all necessary supporting documentation (screenshots, videos, etc.). After this period, and in the absence of a complaint, the Products will be considered compliant and free from any apparent defects, and no complaints will be validly accepted by the Seller.
The Seller undertakes to promptly refund or replace, at its own expense, any Products that present a lack of conformity or a hidden defect, duly proven by the Customer, in accordance with Articles L 217-4 et seq. of the French Consumer Code and these General Terms and Conditions.
The transfer of risks associated with digital Products occurs upon their delivery by email or when they are made available in-game. If the Customer uses a third-party service (e.g., an external platform for file transfer or a third-party digital carrier), the risks are transferred upon the Product being made available to that third party.

ARTICLE 6 - Transfer of Ownership
The transfer of ownership of the Products from the Seller to the Customer will only take place after full payment of the price by the latter, regardless of the delivery date of said Products.

ARTICLE 7 - Right of Withdrawal
Given the nature of the Products sold, orders placed by the Customer do not benefit from the right of withdrawal. The contract is therefore definitively concluded upon the Customer placing the order in accordance with the terms and conditions specified in these General Terms and Conditions.

ARTICLE 8 - Seller's Liability - Warranties
The Products supplied by the Seller benefit from:
The legal guarantee of conformity, for digital Products that are defective, inaccessible, or do not correspond to the description provided when ordering.
The guarantee of proper functioning, in accordance with Articles L. 224-25-12 et seq. of the French Consumer Code.

The seller provides digital content or a digital service that complies with the contract and the criteria set out in Articles L. 224-25-14 and L. 224-25-15.
Article L224-25-13 of the French Consumer Code
In the event of a lack of conformity, the consumer has the right to have the digital content or digital service brought into conformity or, failing that, to a price reduction or termination of the contract under the conditions set out in Articles L. 224-25-17 and L. 224-25-18.
Article L224-25-16 of the French Consumer Code
The consumer benefits from a legal guarantee of conformity for any defect that appears within two years of the single supply of the digital content or digital service.
Complaints and Compliance
To assert their rights, the Customer must report any lack of conformity in writing (email or contact form) as soon as it is discovered.
The Seller undertakes to:
Correct access to or operation of the Product as soon as possible.
If this is not possible, reimburse the Customer within 14 days of acceptance of the request. The Seller shall not be held liable for:
Problems related to the product's compatibility with the Customer's hardware or software.
Incorrect use of the product or service (e.g., violation of a game's terms of use).
External intervention or modification of the product by the Customer.
Temporary unavailability due to maintenance or technical failures beyond the Seller's control.
In the event of a dispute, the Customer may use a mediation service in accordance with Articles L612-1 et seq. of the French Consumer Code.

ARTICLE 9 - Personal Data
9.1 Collection of Personal Data
The Customer is informed that the collection of their personal data is necessary for the execution of the sales contract and the delivery of the Products and services ordered.

When creating a Customer account:
Last name, first name, email address, telephone number, postal address.
During payment:
Payment data is processed securely by our payment service provider (Stripe / PayPal / other). We do not store any banking information on our servers.
9.2 Recipients of Personal Data
The data collected is used exclusively by Modware Store and its authorized employees. It is under no circumstances resold or shared with third parties for commercial purposes.

The Seller implements technical and organizational security measures to protect data against unauthorized access, alteration, or loss. However, the User acknowledges that data transmission over the Internet is never completely secure.
9.7 Customer and User Rights
In accordance with the GDPR and the French Data Protection Act, the Customer has the following rights regarding their personal data:
Right of access: obtain a copy of their data.
Right of rectification: correct incorrect or incomplete information.
Right to erasure (right to be forgotten): request the deletion of their data, unless their retention is necessary (legal obligations, invoicing, ongoing litigation).
Right to restriction of processing: temporarily suspend the processing of their data.
Right to portability: retrieve their data in a readable format and transfer it to another service provider.
Right to object: refuse the use of their data for certain purposes (e.g., commercial prospecting).

9.8 Sales Prospecting
The Customer may receive informational and offer emails from the Seller. They may unsubscribe at any time by clicking on the unsubscribe link in the emails or by contacting the Seller.
ARTICLE 10 - Intellectual Property
The content of the website https://modware.store is the property of the Seller and its partners and is protected by French and international intellectual property laws. Any total or partial reproduction of this content is strictly prohibited and may constitute an infringement of copyright.
